TUCKAHOE, N.Y. – A Tuckahoe woman who was accused of sexually assaulting a Rye Brook woman in August was sentenced Tuesday to six months in jail and five years of probation.
Giovanna Osorio , 41, was sentenced in Westchester County Court on her Nov. 20 guilty plea to one count of assault and one count of attempted burglary, according to a spokesperson for the Westchester County District Attorney's Office. Judge Susan Cacace ruled on the case.
On Aug. 4, Osorio, of 269 Columbus Ave., Apt. 5, Tuckahoe, drove to the victim’s Rye Brook neighborhood in search of her husband, a contractor whom she believed was having an affair with the victim, according to Detective Sgt. Terrence Wilson of the Rye Brook Police Department. Osorio’s husband was in Stamford, Conn., at the time working, and was not at the home.
Osorio broke the kitchen window but was too short to climb through, Wilson said. She unlocked the door using a copy of a key she had made from when her husband had worked there, he said. Osorio went upstairs to the victim’s bedroom, where the woman was sleeping alongside her son, Wilson said.
The woman was startled but recognized Osorio from previous contact, and a scuffle ensued, Wilson said. Osorio grabbed the victim’s hair, bit her on the nose, pushed her and sexually assaulted the victim’s rectum.
“[Osorio] grabbed her hair and bit her on her nose,” he said. “She pushed her on the bed and grabbed her between her private area. She inserted her finger in the woman’s rectum, causing injury.”
Osorio left as the woman called the police. But she returned and was arrested, Wilson said. She told police she believed her husband was cheating on her with the Rye Brook woman.
Under the initial indictment, Osorio faced a maximum of 15 years in prison.
In October, following Osorio’s arraignment, Westchester District Attorney Janet DiFiore issued a statement, calling the assault “disturbing.”
“Jealousy, rage and loss of control over an alleged relationship are no excuse to break into someone’s home in the middle of the night in an attempt to humiliate the victim,” DiFiore said. “... For the entire assault to be witnessed by the victim’s 4 year old son is even more disturbing.”
