Robert Burgos, 42, was charged with second-degree breach of peace, second-degree reckless endangerment, assault on a peace officer, criminal mischief, second-degree threatening, third-degree assault and interfering with an officer. He was held on $10,000 bond and will appear in court Nov. 28.

Police received a report of a disturbance at the Raimy Market on Ely Avenue at 6:42 p.m. Monday, Nov. 17. The clerk told officers that Burgos had bought gum, and then started trying to instigate an argument with the clerk, police said.

The clerk said Burgos appeared intoxicated, and he tried to come behind the counter, according to police. He then pushed the clerk, and the two began fighting and fell to the floor, knocking over items, police said. Other customers had to step in and break up the fight, police said.

As Burgos was leaving, he began threatening to kill the clerk, and then picked up a large pickle jar and threw it, smashing it on the ground, according to police reports. He then fled on foot down Ely Avenue.

Officers looked at surveillance footage, and recognized Burgos by his tattoos, police said.

They went to nearby Roodner Court, where they believed they would find him, and knocked on his door, police said. A woman answered and told officers that she didn't know Burgos, then admitted that he was her boyfriend, police said. She told officers that she did not know where she was, and allowed them in to search for him, according to police reports.

The officers found Burgos hiding under a bed, and said he refused to come out. Police got him out and handcuffed him.

Burgos was irate and uncooperative, and appeared intoxicated, according to police reports. He said he didn't do anything, but the clerk was able to positively identify him. Police also found the clothes he was wearing during the incident, according to police reports.

When taken to police headquarters, Burgos told the officers that he would fight them as soon as the handcuffs were off, police said. He also made threats of a sexual nature against the officers, according to police reports. He was uncooperative during the booking process, and spit on paperwork and the officers processing him. He eventually had to be carried to his cell, police said.
