Gabay, a 43-year-old lawyer and the first deputy general counsel of the Empire State Development Corp., was caught in the crossfire between rival gangs just before the West Indian Day Parade in September 2015, according to multiple media reports.

He suffered a gunshot wound to the head while walking along a Brooklyn sidewalk with his brother and died more than a week later, media reports said.

Police announced Friday, May 27, that they had arrested 23-year-old Micah Alleyne in connection with the shooting, media reports said.

Alleyne reportedly lived in a homeless shelter in Jamaica, Queens.

He has been charged with second-degree murder, as well as reckless endangerment, and criminal possession of a weapon, police said.

Gabay started working with the Cuomo administration in 2011 as an assistant counsel.

Cuomo, who lives in Mount Kisco, called Gabay “an exemplary public servant who lost his life in a senseless tragedy.”

In his statement, the governor also praised investigators and prosecutors “for their tireless efforts to ensure those responsible for Carey’s death are held fully accountable for their actions.”

According to a report by cbsnews.com, more arrests are expected.

Brooklyn District Attorney Ken Thompson also released a statement via Twitter.

"As I have said from the beginning, we are determined to get justice for Mr. Gabay and his family,” Thompson said, adding that his office would continue to “press forward” until everyone involved in Gabay’s death is held "accountable."
