McNair, a 62-year-old passenger in Morgan's limo van, was killed when the Wal-Mart truck crashed into the back of the vehicle, leaving Morgan with a broken femur, nose and several broken ribs, according to 7online.com.

A volunteer at the Salvation Army and a worker at the Jan Peek House, McNair was known to put Peekskill first and was thought of as a compassionate and caring member of the community.

Wal-Mart also reached a settlement with the two children of McNair, but neither of the settlements' details were released, reported 7online.com.
