Code Enforcement Officer Ed DiBuono and his wife, Town Clerk Jacqueline Greer were at Delfino's restaurant when a woman identified as Mary Ann Vaccaro reportedly came up and spit in DiBuono's face, LoHud.com reported.
Both DiBuono and Greer told police that Scott Croce then pulled DiBuono from his seat and a fight ensued. Surveillance footage, on the other hand, shows DiBuono getting up on his own accord with Greer attempting to stop him before the altercation began, LoHud.com said.
Harrison Police Chief Anthony Marraccini has said he feels both DiBuono and Greer should have been charged with making false statements to the police, but no charges were brought against either party, and the police were directed by the Town Board to forward the evidence to the Westchester County District Attorney's Office for a final determination, according to LoHud.com.
